Fox News host Chris Wallace on Sunday demonstrated the circular and incoherent reasoning of the Trump legal team as he battled Jay Sekulow, a conservative activist who has found a spot as a Trump lawyer — apparently, in part, because of the President’s difficulty in retaining qualified counsel.
During an interview which became increasingly testy, Sekulow attempted to defend Trump’s position that he was under investigation by denying that he is under investigation. He then attempted to make a circular argument regarding the President’s firing of former FBI Director James Comey.
“He takes the action that the [Attorney General’s office] recommended and now he’s being investigated by the Department of Justice,” Sekulow said as he tried to explain one of Trump’s most recent tweets wherein Trump stated that he is “being investigated for firing the FBI director by the guy who told me to fire the FBI director.”
“He’s being investigated for taking the action that the Attorney General and Deputy Attorney General recommended him to take by the agency who recommended the terminations,” Sekulow added.
The explanation gives a glimpse into how Trump’s legal team is thinking of defending the President. Specifically, they seem to be arguing that Trump could not have obstructed justice because the investigative agency conducting the Russia probe recommended the firing of the FBI director. This, despite the fact that Trump has already admitted that any recommendation one way or the other did not have had any effect on his decision.
The explanation, however, touched off another inconsistency which Chris Wallace attempted to point out. Specifically, Sekulow had declared unequivocally that Trump was not under investigation. Wallace therefore probed when he was now saying that Trump was under investigation.
“You’ve now said he is being investigated after saying [he isn’t].” Wallace said.
“No, he’s not being investigated,” Sekulow fired back as the two repeatedly went back and forth on the issue, at one point, Wallace reminding Sekulow that the two are being taped.
“Sir, you just said two times that he’s being investigated,” Wallace tried to explain. “And he’s not just being investigated for firing Comey. There’s also what he said to Comey when Comey was still the FBI Director,” Wallace added implying that any obstruction of justice investigation would not be limited to the firing of Comey, but also all of the other actions that Trump is alleged to have taken.
“I do not appreciate you putting words in my mouth, when I have been crystal clear that the President is not and has not been under investigation,” Sekulow said.
“You do not know that he has not been under investigation, sir,” Wallace corrected Sekulow. He then called him out on what can only be described as a shell game that Sekulow was playing during the interview. “Actually, what I’m trying to do is to get a straight answer out of you.”
Undeterred, the Trump lawyer continued with the shell game arguing that it would be impossible to indict Trump for wrongdoing “because there is not an investigation.”
“Oh boy,” Wallace responded in frustration. “This is weird.”
